两个要点：一是必须与产品结合，纯粹的图案本身、不能工业应用的美术创作不属于保护范围；二是必须为“新”设计，审查标准为不属于现有设计、且与现有设计或现有设计特征的组合相比有明显区别，同时不与他人在先取得的合法权利相冲突。保护期为十五年，自申请日起算，适用于2021年6月1日之后提出的申请；此前提出的申请保护期为十年。外观设计专利须缴纳年费维持专利有效性。
